Shmyndruk O. The preparatory proceeding in the criminal process of Ukraine.

The dissertation is devoted to complex research of the genesis, concept, content and objectives of the preparatory proceeding values, its character and decision-making procedure in thіs proceeding at first instance, issues related to the preparation for trial. The paper highlights the history and development of institute of preparatory proceeding in Ukraine and some foreign countries. The genesis, concept, content, objectives, values and procedures of the institute of preparatory proceeding at first instance are defined in the dissertation. The nature and order of the court decision on the merits of the preliminary proceeding is analyzed, terminating criminal proceedings with exemption from criminal liability; terminating the criminal proceeding on neutral (procedural) grounds; approving or refusing to approve the agreements. The issues that are resolved by the court in the preliminary proceeding is revealed, referring the criminal proceeding to determine jurisdiction; the returning of the indictment, the request for the imposition of compulsory measures of medical or educational nature, a request for exemption from criminal liability to prosecutor; purpose of criminal proceeding for the trial and the issues associated with its preparation. A number of offers for improving the criminal procedure law regarding preparatory proceeding are made.
