Lytvyn O. Criminal Procedure of Proof in Trial.

The Dissertation is the first complex study of special aspects in criminal procedure of proof in trial of a case, based on The Criminal Action Code of Ukraine 2012 year. The essence, features and elements of criminal procedure of proof on trial of a case are analyzed. The particularity of judgment, made by court at the process of determination of evidences for intermediate and final court decision at the trial of a case, are examined. The procedure of recognition of the evidences as the incompetent ones is characterized. The role of court and parties at the process of establishing circumstances of criminal case are defined. The authority of court concerning the procedure of proof is characterized and the problem of court’s activity during the process of proof at the trial stage is investigated. The particularities of the process of proof in the criminal cases, based on an agreement at the trial stage, are defined. Scientifically grounded propositions for the improvement of criminal procedure law of Ukraine in part of regulation of proof at the trial of a case are introduced.
