Vitiuk D. Administrative and legal bases of judges' public service

The dissertation represents the legal analysis of the system of courts of general jurisdiction in Ukraine, and the analysis of requirements for candidates for judges. The basic terminology concepts, such as "legal status", "public service", "public servant", and etc., are analyzed. The scientific and legal sources are examined. The definition, content and legal regulation of administrative and legal principles of judges' public service in Ukraine are offered. The author formulates the above principles, demonstrates the elements of their content, and describes their legal regulation. The dissertation examines the legal nature, content and substance of the structural elements of the administrative and legal status of the judges of the general jurisdiction courts: their rights and duties. The characteristic and classification of rights and duties are given. The dissertation reveals the nature and the mechanism of the judges' disciplinary liability. The paper represents a comprehensive investigation of theoretical problems related to legal regulation of administrative and legal status of the judges of the general jurisdiction courts. Based on the conducted research, the specific proposals as to the amendment of the Constitution of Ukraine as well as to the Law of Ukraine "On the Judicial System and the Status of Judges" aimed at improvement of the administrative and legal bases of judges' public service in Ukraine are given.
