The main stages of formation of institute of detention in criminal trial of Ukraine are investigated, the place of detention by the authorized official in system of measures of providing criminal proceedings is established, the concept and the legal nature of detention are defined by the authorized official. The bases, conditions, motives and order of detention by the authorized official, the bases and a procedural order of release of the detained person or an appeal to the court with the petition for election of a measure of restraint concerning him are analysed. The concept, essence and system of means of ensuring of the rights and legitimate interests of the detained person are opened.
