In particular, the proposed signs of civil claim are proposed and singled out a civil action elements proving its subject on the basis of the current Criminal Procedural Code of Ukraine, provided differentiation of subjects of proving a civil claim in the criminal proceedings, role of the court is established in this activity, content, foundations of competition in the activity of the sides in the criminal proceedings on supporting and denial of declared civil claim are considered. The subjects' activities of the criminal proceedings which from the prosecution side as well as from the defense side of proving the civil claim are grounded.
