Malakhova O. Implementation of institute of defence promotion in criminal procedure proving.

The dissertation is the first special comprehensive research that is devoted to the implementation of favor defensionis in criminal procedure proving according to the current criminal procedural legislation of Ukraine. The concept of institute of defence promotion in criminal procedure proving, as a specific legal mechanism, the purpose of which is to ensure the procedural equality of parties to criminal proceedings, is developed. The essence and significance of favor defensionis, as an institution of the criminal procedure law, are determined. Its structure and content according to the current criminal procedural legislation of Ukraine are defined. Process of collecting and examining evidence during the pre-trial investigation and the court proceedings in the first instance is characterized taking into account the functioning of institute of defence promotion. The procedural opportunities of the defense of independent collection of evidence during pre-trial investigation are examined.
