Savitska V. Administrative and legal fundamentals of protection of selection achievements in plant growing of Ukraine.

The thesis is devoted to study of the administrative and legal fundamentals of protection of selection achievements in plant growing of Ukraine. On the basis of modern methodological approaches, doctrine analysis of theoretical sources of administrative legal science, generalization of norm setting and law-enforcement practice in the field of the protection of selection achievements in plant growing of Ukraine, the new or clarified definitions of a number of administrative and legal categories and concepts are offered. It is pointed out to a close link of the protection of plant varieties and selection achievements and influence of the norms of administrative law in the control of these relations. On the basis of generalization of norms of the national and international legislation, study and analysis of practical matters, the theoretical and legal fundamentals of protection of selection achievements in plant growing are investigated systematically and comprehensively. The historical analysis of formation and development of administrative institute, principles, goal, tasks, functions and methods of control of the field of selection achievements in plant growing are researched. The analysis of the activity of executive bodies was conducted in the field of protection of rights to plant varieties as the intellectual property item, the suggestions to improve the activity of such bodies are made. As a result of the conducted investigation, a number of proposals was formulated for legislation improvement and other regulatory legal acts on the protection of property and non-property rights to plant varieties of plant breeders and other subjects of intellectual property rights.
