Burtsev O. Legal principles of settlement of disputes regarding land boundaries.

The dissertation is devoted to complex scientific development of legal principles for settlement of disputes regarding the land boundaries by clarification of theoretical provisions relating to the legal nature of such types of disputes, and establishment of major development trends and the current state of legal regulation of relations in this area, identification of problems, which arise while regulation of such land relations, and development of concrete proposals for their solution. Historical and legal analysis of the evolution of the legislation on resolving disputes regarding land boundaries is made. The legal nature of such disputes is considered, their types are distinguished. The features and characteristics of disputes concerning land boundaries are outlined. According to the revealed nature, inherent characteristics, and specificity of researched disputes concerning land boundaries, their classification according to different criteria is proposed. On the basis of analysis of the practice of resolving disputes regarding land boundaries, interrelation between judicial and extrajudicial settlement is disclosed, the advantages of each type of settlement are grounded. Scientifically grounded proposals concerning improvement of the legal regulation of social relations in the field of settlement of disputes regarding land boundaries are developed.
