Nagornyuk-Danyluk O. Special criminal proceedings in criminal process of Ukraine

The definition of a special criminal proceeding was defined and it's importance in the criminal process of Ukraine was described basing on the analysis of the native and foreign scientists' researches and provisions of the Code of Criminal Procedure of Ukraine. The process of establishment and legislative recognition of the institution of the special criminal proceeding in different historic periods was examined. The characteristic features peculiar to special pre-trial investigation and a set of circumstances which are to be identified by the investigating judge during the hearing of a plea for the special criminal proceeding were determined. The most common problems incidental to the performance of the special criminal proceeding in the criminal process of Ukraine and the solutions for them were defined in this research. Particular attention was paid to the survey of the foreign experience in this sphere wherefore the analysis of the criminal procedural legislation of certain countries in Europe and CIS was conducted.
