Kuzmenko V. Usage of Measures of Procedural Compulsion in Administrative Proceedings

The dissertation is devoted to complex research of the issues of the usage of measures of procedural compulsion in administrative proceedings for the purpose of disclosure of measures of procedural compulsion in administrative proceedings, as well as to identify common patterns of (features, types, terms, conditions and procedure of the order) of their application in administrative proceedings. The scientific concept of procedural compulsion, the ratio categories: procedural compulsion, administrative compulsion and compulsion in the administrative proceedings, clarified the legal nature of procedural compulsion in the administrative proceedings, as well as administrative procedural responsibility. The author defined the basic grounds of the usage of measures of procedural compulsion in administrative proceedings, and given the legal characteristic features of the usage of the warning, expulsion from the courtroom, a temporary withdrawal of evidence by the court for investigation and forced conveyance to the court as measures of procedural compulsion in administrative proceedings. Studied the legal regulation of the usage of measures of procedural compulsion in administrative proceedings in foreign countries, international legal basis for their usage, as well as the prospects of reforming the legislation on the usage of measures of procedural compulsion in administrative justice in Ukraine.
