Karakhanian K. Legal basis of competitive land sales in Ukraine

The thesis is devoted to complex research of legal principles of competitive land sales in Ukraine. The study found the ratio of the concepts of «land tender» and «land auction», the content of the basic concepts in the field of auction alienation of lands. An author proposes to supplement existing at the doctrinal level list of principles for land auctions with principle of freedom of participation in land sales and principle of returning the contributions of participants of land sales. Characterized regulatory framework, which is a system of legislation in the field of competition alienation of land. Special attention is paid to the definition of land as an object land auction, as well as establish the range of subjects and basic requirements that apply to them as members of a competitive land sales. Analysis of land legislation revealed features of organizing and conducting land auctions for certain groups of land, found major shortcomings in this area and the ways to overcome them. In addition, in order to determine the list of land to be sold on a competitive basis, determined the most complete range of land plots, which are subject to sale outside the auction. As a result of the study the author made a number of new scientific findings on the competitive sale of land in Ukraine, and suggested proposals for the solution of problems of legal regulation, improvement of existing legislation.
