Sayenko G. Proceeding on the basis of agreements in the criminal process of Ukraine

The dissertation is dedicated to the system research of the legal regulation in specific order of proceeding based on the agreements in the criminal procedure of Ukraine. Historical progress in contractual relationships of adjustment in the legal conflicts between the parties is investigated considering international experience and conception of the legal institution of deals on the territory of Ukraine. Legal content of proceeding based on agreements is determined; correlation among personal and public interests in this proceeding is analyzed. Legal nature substance of treaty relations among parties of proceeding is solved; reasons and conditions for agreement in proceeding are found. Types of agreements in proceeding of Ukraine, the contents, legal procedure in order of agreements, legal consequences of agreements for parties are characterized. Main defects in agreement on reconciliation and confession of guilt are depicted. Offers for procedural participation by prosecutor and advocate in confession of guilt agreement are developed.
