Bondiuk A. Procedural basis of the status of the investigator of the judge in criminal proceedings

The thesis presents a comprehensive study of theoretical and practical issues of the investigating judges functions as subjects responsible for judicial review in criminal proceedings. Historical and legal analysis of the judicial control institution formation and development in Ukrainian criminal proceedings is presented. Foreign experience of investigating judge performing the judicial control in criminal proceedings is studied. The peculiarities of the abovementioned functions legal regulation are outlined. Investigation of investigating judge's functions performance is made in the context of prosecutor's/investigator's procedural motions consideration (investigative (search) operations, covert investigative (detective) actions and other proceedings). Suggestions on amendments and supplements to the Code of Ukraine concerning improvement regulation of the investigating judge in criminal proceedings. Amendments for relevant Criminal Procedure Code provisions are offered.
