In the dissertation a comprehensive study of the gaps in the criminal procedural law was carried out on the basis of analysis of the research conducted by domestic and foreign scientists, legislation and practice of its application, generalization of empirical data. The history of the appearance and development of theoretical ideas about the gaps as an independent legal phenomenon is also considered in this work.
