The thesis is devoted to the complex analysis of theoretical positions Institute of proof, its limits and conditions to be established regarding a criminal offense. Proved that the proof is the kind of learning process, which is carried out according to the laws of logic, in legal form. A proof define limits on pre-trial and trial investigation, provided their classification. Provided procedural form of agreement between the parties during the election of a preventive measure, the closure of criminal proceedings, the definition of inadmissible evidence – admissible.
