Ahapova O. Administrative and Legal Principles of the Activities of the National Guard of Ukraine

Object of research: civil relations arising in the course of the activities of the National Guard of Ukraine. Goal of research: to determine the nature and features of the administrative and legal foundations of the activities of the National Guard of Ukraine, as well as to formulate proposals and recommendations for their further improvement, taking into account both domestic and international experience. Research methods: a complex of general scientific and specially juridical methods of research: historical, dialectical, comparative legal, statistical and other. Scientific novelty: the scientific approach to the classification of functions performed by the National Guard of Ukraine during the operation of various administrative and legal regimes in the territory of the state is improved. It has been clearly shown that the National Guard of Ukraine functions in the status of "law enforcement forces" (in peacetime, in the introduction of the legal regime of the state of emergency) and as an additional military force (in the case of the introduction of a legal regime of martial law). The necessity of supplementing the fundamental principles of the activity of the National Guard of Ukraine with the principle of "integrity" is grounded. The need to provide military men of the National Guard of Ukraine with the right to draft protocols on administrative violations is formulated and scientifically substantiated. The system of administration's subjects of the National Guard of Ukraine is defined and classified. Practical importance: Theoretical propositions, suggestions and recommendations of the study could be served as a basis for further development of scientific thoughts and they conduce to the improvement of the practical activities of the National Guard of Ukraine when preparing and amending the current legislation of Ukraine. Field of application: Materials of research can be used in teaching students of higher education institutions in such disciplines as "Administrative Law", "Administrative Process" and others.
