Slyusarchuk K. Standards of proof in criminal proceedings

The dissertation is devoted to the concept formation of the standards of proof in the criminal proceeding, as well as to improve their legal regulation. The nature and the classification of the standards of proof, the purpose of their introduction in the criminal proceeding, as well as the system of the standards of proof, have been highlighted. The signs characterizing such standards of proof as “reasonable suspicion”, “probable cause”, “preponderance of evidence”, “clear and convincing evidence” and “beyond a reasonable doubt” and the ways of their applying have been difined. On the basis of the analysis of the norms of the criminal procedural legislation, as well as doctrinal approaches, the proposals on improving the legal regulation of the standards of proof in the criminal proceeding have been formulated.
