Likhter M. Environmental and legal framework for sanitary and epidemic welfare of the population in Ukraine

Dissertation is focuses on theoretical and legal foundations of environmental and legal framework for sanitary and epidemic welfare of the population in Ukraine, removal solutions to problems in this area and formulate appropriate recommendations to improve the current legislation. The legal nature of the right of sanitary-epidemic welfare was revealed. The definition of «well-being» for the purposes of environmental legislation was provided, legal definition of sanitary and epidemic welfare was improved, the ratio between the sanitary-epidemic welfare of the territory and sanitary-epidemic welfare of the population was found out. The classification of legislative norms, which ensure the legal regulation of the investigated sphere, was carried out. The general and specific principles of legal regulation of sanitary and epidemic welfare were determined. A place for the sanitary and epidemic welfare in system of subjective environmental rights was established and its features were revealed. The specific provision of sanitary and epidemic welfare in cities was investigated. The features of management of sanitary-epidemic welfare was found out and the legal basis of the functional software of this area was considered. The concept, characteristics and types of legal liability, which is used for violation of sanitary legislation, was disclosed. On the basis of the scientific work specific changes and amendments to the legal framework of Ukraine were proposed by the author.
