Radchenko O. Administrative and legal protection of financial services consumers’ rights

The thesis provides a comprehensive study of the legal and administrative problems in protecting the financial services consumers’ rights. The definition of «administrative and legal regime of financial services consumers’ rights protection» was developed and disclosed its contents. The historical aspect in the emergence and development of administrative and legal financial services consumers’ rights protection in Ukraine was studied. The paper addresses the system and structure of state bodies which carry out financial services consumers’ rights protection. The objectives, functions and powers of state authorities to protect financial services consumers’ rights were analyzed. The proposals to optimize the quantitative composition and functional public authorities provisioning to implement policy in the financial services industry effectively were developed. The ambiguous administrative and judicial practice on financial services consumers’ rights protection in Ukraine was considered. It identifies the main problems in the state regulation on ensuring the financial services consumers’ rights protection in Ukraine and proposals to overcome them. The author studies the issues on the administrative responsibility for offences in the sphere of financial services consumers’ rights protection in Ukraine. The comparative analysis of norms in the European Union and Ukraine with the aim to harmonize the legislation and to implement the rules in the framework of the Association Agreement between Ukraine and the EU was made.
