Kyryliuk I. The Right to Appeal a Decree within Administrative Judicial Proceedings of Ukraine

The dissertation is focused on the systematic study of the scientific and practical problems of the implementation of the right to appeal the decrees within administrative judicial proceedings of Ukraine. The author has clarified the essence and has formulated the notion of the right to appeal the decrees. The author has carried out the allocation between the preconditions of the origin from the conditions of the implementation of the right to appeal a decree. The object, subject matter and limits of an appeal of a decree within administrative judicial proceedings of Ukraine have been determined. The system of subjects of an appeal of a decree has been characterized. The requirements relating to an appeal and its structure have been considered. The author has developed some propositions for improving the procedure and terms of an appeal of a decree. By the way of a critical analysis of the provisions of the draft of the Law on amendments to the Code of Administrative Court Procedure of Ukraine the author has suggested the ways to improve such additional mechanisms for implementing the right to appeal a decree as accession, supplementing and changing an appeal, a denial of an appeal, the withdrawal of an appeal, and waiver of it.
