Essay

The thesis is the first work in the domestic science of labor law offering special comprehensive comparative legal study of the legislative regulation of the employment contract termination procedure under Ukrainian and Polish law. The "employment contract termination" notion was defined, and its difference from related notions was outlined. Legislative regulation of the employment contract termination procedure under Ukrainian and Polish law has been analyzed. Particular grounds for termination of employment contract under Ukrainian and Polish law have been characterized. The procedures of termination of employment contract under Ukrainian and Polish law upon agreement (mutual consent) of the parties, at the employee's initiative, at the employer's initiative and as a result of circumstances beyond control of the parties have been reviewed. Peculiarities of the procedure of termination of the employment contract with certain employee categories under Ukrainian and Polish law have been ascertained (with pregnant women, women who have children, employed minors and managers of legal entities). Scientifically substantiated suggestions regarding amendment and supplementation of the acts of the current labor legislation and the draft Labor Code of Ukraine have been formulated on the basis of Poland's positive lawmaking experience.
