Vitiv V. Information rights of persons in the field of environmental protection

This dissertation contains a set of theoretical and practical issues related to the study of the essence, content and grounds of administrative and legal regulation of information rights in the field of environmental protection. On the basis of the current legislation the concept, purpose, objectives and principles of information rights in the field of environmental protection were formulated. In the dissertation the analysis of the general theoretical problems of legal regulation of information rights in the field of environmental protection, the legal essence of the notion «information rights of persons on the state of the environment», «information rights of persons in the field of environmental protection», «environment», «informational autonomy», «the right to information», the relation between concepts «information rights» and «right of access to information» was made. The experience of normative legal regulation of information rights in the field of environmental protection of the Federal Republic of Germany has been analyzed. It was established that the use of the acquired experience of legislative regulation of relations in the sphere of information rights in the field of environmental protection will help with further development and improvement of the domestic legal framework, will allow avoiding a repetition of a number of mistakes in the field of public administration. In the process of studying the existing regulatory framework, statistics and practices in the implementation of information rights in the field of environmental protection a conclusion that there are a number of gaps, collisions and other shortcomings in the legal regulation of the procedure for ensuring information rights in the field of environmental protection was made. In this regard, specific measures concerning improvement of the regulatory framework for information rights in the field of environmental protection were proposed.
