Brintsov A. The Codification of the Agrarian Legislation of Ukraine

The dissertation is devoted to the clarification of the essence of the scientific and legislative foundations of the codification of the agrarian legislation of Ukraine, developed its own recommendations for its practical implementation. The dissertation formulated a scientific definition of the notion of codification of Ukrainian agrarian legislation and its peculiarities. The peculiarities of the emergence and development of scientific views and ideas on the codification of domestic agricultural legislation in the context of the history of the formation of the agrarian law of Ukraine have been researched. We propose our own view on the appropriate periodization of their development. The purpose and tasks of codification of agrarian legislation of Ukraine are determined. The correlation between the object and the object of codification of the agrarian legislation of Ukraine was established, and the scope and content of the concept of agricultural legislation as an appropriate subject of codification were clarified. The principles of codification of agrarian legislation of Ukraine have been formed and their classification has been proposed. The content of types and forms of codification of agrarian legislation of Ukraine is revealed, their correlation is proposed. An analytical review of modern models of existing codified acts of agrarian legislation of the countries of the world was conducted, a comparative legal analysis of the foreign experience of codification of agrarian legislation was carried out and the main ways of its borrowing in Ukraine were outlined. The state and perspectives of codification of agrarian legislation of Ukraine are elucidated, including theoretical conclusions and practical recommendations for the elaboration of the Concept of the Agrarian Code of Ukraine, as well as its structure.
