Sushcha L. Legal principles of losses compensation to land owners and land users in Ukraine

The dissertation is devoted to the complex and comprehensive study of the legal principles of losses compensation to land owners and land users in Ukraine. The work contains a theoretical synthesis and a new solution of a scientific problem in the field of legal regulation of relations concerning losses compensation. According to the results of the study periodization of historical development and establishment of the institute of losses compensation was made, the current state of legislative provision of this sphere was analyzed. The work substantiates the signs and formulates the definition of "losses", defines the functions of losses and conducts their classification. The division of the notion of losses with other contiguous categories was made, special attention is paid to the ratio of the concepts of "losses" and "damages" in land relations. The legal grounds for losses compensation to land owners and land users were examined in details. Much attention is paid to the legal mechanism of seizure (redemption) of agricultural and forestry lands. The grounds for losses compensating to the owners of land and land users caused by the offenses were analyzed.
