Bilovus R. Legal regulation of public use of mineral wealth.

In work on the basis of the study of scientific literature, legislative and other normative legal acts, a comprehensive study of the legal framework for the implementation of subsoil use in the general procedure was carried out. The historical and legal aspect of the formation and development of common subsoil use is analyzed; formulated and disclosed the legal content of the concept of "general use of subsoil"; The characteristic features, forms of realization and mechanisms of legal regulation of the order of realization of the general using of bowels are analyzed. Legal foundations for the general use of subsoil for mining and for purposes not related to the extraction of minerals have been determined and analyzed. Based on the existing theoretical and legislative base, the specifics of establishing restrictions and control over the implementation of public use of subsoil have been explored. Particular attention is paid to guarantees of the realization of the right of general subsoil use as one of the main environmental human rights. The theoretical conclusions are drawn, a number of problems are outlined that require urgent solution, proposals are formulated to amend the current legislation, which will allow improving the legal regulation of subsoil use in Ukraine, incl. on a universal basis.
