Essay

The object of research is the general study of the state by C. Schmitt. The main aim of the study is interpretation by C. Schmitt the issues of organization and functioning of the institutions of law, detection of scientific rational structural elements in the opinion of the scholar, determination of the prospects of their use in the process of development of Ukrainian statehood. In the study the institutional method, the systemic method, the structural-functional method, the hermeneutic method have been used. The analysis of the key aspect of the doctrine of the state of C. Schmitt, a rule of law in terms of its principles, has been conducted. Theoretical and practical significance of the results is primarily to expand knowledge of the scientific and theoretical heritage of German scientist Carl Schmitt, whose main theoretical and political ideas can be used in the process of further developing political and legal concept of improving Ukrainian statehood with the account for features of modern modernization processes in the state.
