Shepitko I. Court hearing (trial) in the system of judicial proceedings at trial court

The problem of court hearing (trial) as a stage of judicial proceedings at trial court is investigated in the thesis. The characteristics of certain types of court hearing are given, the role of the general principles of criminal proceedings for the procedure of trial is determined, the peculiarities of the commencement of the trial and the clarification of the circumstances of the criminal proceedings and verification of its evidence are determined. The essence and content of the trial and its structural components (elements) – judicial actions of a cognitive nature are revealed. Verbal, non-verbal and mixed (systemic) judicial actions have been investigated. The types of judicial actions are specified. The procedure for conducting them in a competitive criminal procedure is determined. Based on the conducted scientific research and generalization of judicial practice, the author`s proposals are formulated, aimed at improving the criminal legislation of Ukraine.
