Mykhalskyi O. Administrative and Legal Counteraction to Offenses in the Field of Intellectual Property in Ukraine

The dissertation is focused on the analysis of the essence and peculiarities of counteraction to offenses in the field of intellectual property in Ukraine, as well as the ways to improve its administrative and legal regulation. The notion of intellectual property as an object of administrative and legal counteraction has been defined. The historical and legal analysis of counteraction to offenses in the field of intellectual property in Ukraine has been carried out. The essence and content of the state and legal mechanism of counteracting offenses in the field of intellectual property in Ukraine have been established. The author has characterized the legal principles of counteracting offenses in the field of intellectual property in Ukraine and has established the place of administrative and legal regulation among them. The objective and principles of administrative and legal counteraction to offenses in the field of intellectual property in Ukraine have been revealed. The levels, directions and the range of subjects of counteracting offenses in the field of intellectual property in Ukraine have been clarified. The forms and methods of counteracting offenses in the field of intellectual property in Ukraine have been determined. International experience of counteracting offenses in the field of intellectual property has been generalized and the possibilities of its implementation in Ukraine have been determined. The ways of optimization of the system of counteracting offenses in the field of intellectual property in Ukraine have been offered. The author has processed propositions on improving administrative legislation, which provides liability for violations in the field of intellectual property in Ukraine.
