Lysenko S. Administrative and Legal Regulation of Entrepreneurial Activity in Trade

The dissertation on the basis of the theory of administrative law, domestic and foreign legislation provides a new solution of the scientific problem regarding the development of foundations and administrative tools regarding the administrative and legal regulation of entrepreneurial activity in the field of commerce. It has been proved that the administrative and legal regulation of entrepreneurial activity in the tradesphere is based on the administrative and legal norms of the activities of the public administration bodies in order to protect the individuals’ rights and legal entities on quality and safe products (consumer rights protection), promotion of entrepreneurial trade, protect them from violations by the state authorities. Furthermore, it has been ascertained the administrative and legal status of public administration, which regulates business activity in the trade sphere, which is a set of administrative duties and rights, tasks and powers of the subjects of public administration, which they are legally entrusted with the purpose of regulating the target trade sphere, determines the hierarchical place of the public administration in the system of public authorities and may be subject to administrative (special disciplinary) responsibility for non-fulfillment and improper implementation of their legally defined duties.
