Essay

The dissertation is a complex research of administrative and legal protection of animals from ill-treatment, which are involved in various types of human activities. A thorough and consistent analysis of the current national legal and regulatory framework was carried out, in particular, numerous sub-normative legal acts, which carry out administrative and legal regulation of protection against ill-treatment of various groups of animals: wild, agricultural, domestic, experimental and animals involved in the organization of events; the current state and trends of development of administrative responsibility for ill-treatment of animals are analised; directions of perfection of the normative-legal base of Ukraine are offered, taking into account its shortcomings and difficulties of practical realization. Authorities and the place of public administration bodies in the implementation of administrative and legal protection of animals from ill-treatment are considered and determined. Some weaknesses in the implementation of power and administrative functions in the implementation of administrative and legal protection of animals from ill-treatment are revealed – the absence or imperfection of the effective subnormative legal acts, weak supervision and control over the conditions of keeping and handling animals. Proposals for overcoming the deficiencies in the work of state authorities and local self-government are developed through adoption of amendments and additions to the legislation, adoption of new rules, procedures, programs and improvement of existing sub-normative legal acts were achieved. The work focuses on overcoming the negative phenomenon of homelessness of animals; ensuring the welfare of farm animals and humane methods of slaughter; protection against ill-treatment and observance of conditions of maintenance of experimental animals; transportation of different groups of animals; administrativelegal protection of animals which are involved in leisure activities of people, especially in circuses, dolphins; issues of euthanasia of animals. The definition of «animal movement», which is mainly compulsory for animals, is developed and the necessity of introducing it into the legislation on protection of animals from ill-treatment is grounded.
