Krytska I. Material evidences in criminal proceedings.

The theoretical and practical aspects of normative regulation of procedural order of formation of material evidences and their using in criminal proceedings are investigated in the thesis; also doctrinal definition of the concept of material evidence has been improved; their essential elements and signs are revealed; the correlation between material evidences and other material objects is established; the author's classification of material evidences has been proposed, depending on the method of their acquisition and on the the nature of the restriction of the right to their receiving. The essence and structure of the procedural mechanism for the formation of material evidence in criminal proceedings and its elements are considered. Based on the conducted research and generalization of enforcement practices were found deficiencies of legal regulation of the procedural order of formation of material evidence in criminal proceedings and formulated scientifically based proposals aimed at improving the current criminal procedural legislation.
