Ponomarenko Y. Legal regulation of dismissal of a judge from office and termination of his powers

The dissertation is devoted to a comprehensive study of theoretical and practical issues of legal regulation of dismissal of a judge from office and termination of his powers, author classification of historical stages of development of legal regulation in this area is carried out. The general theoretical aspects of termination of labor relations are studied, the signs of dismissal and termination of powers of judges are formed as grounds for termination of an employment contract with its participation, revealing the current state of international legal and national legislation. Describing the constitutional grounds for dismissing a judge from office, termination of his powers, the author focuses on the procedures that take place in the legal mechanism of terminating the legal status of judges. Particular attention is paid to the fact that the process of dismissal and termination of powers is also accompanied by a number of guarantees to judges as employees, the allocation and classification of these guarantees is carried out. In the context of a comparative study, we study the foreign experience of legal regulation of dismissal of a judge from office, termination of official authority. The problems of normative regulation of termination of the legal status of a judge are outlined, a number of perspective directions of improvement of the legislation of Ukraine in this sphere are proposed.
