Dissertation is devoted the theoretical and practical aspects of realization of institute of court decisions in a criminal process. On the basis of complex analysis of scientific labours, current legislation, judicial practice, penal judicial laws of foreign countries of the continental system of right, considered theoretic legal principles of institute of court decisions in a criminal process, him legal nature and maintenance, problems of realization of this institute during realization of criminal realization and directions of improvement of penal judicial law are in this sphere. Consisting of scientific developed of problems of institute of court decisions is analyses of criminal process and the presence of unexplored questions is established in his study. Legal nature and maintenance of institute of court decisions is considered in a criminal process through a historical retrospective view and to offer author his understanding.
