Kohutych I. Аdministrative-legal guarantees of notary activities in Ukraine

Author defines key components of notary administrative-legal status. Specific features of notary administrative-legal status are characterized along and individual interpretation for its definition along with guarantees place in the structure of notary administrative-legal status is provided. Applicable legislation is examined along with scientific approaches to systematization of notary administrative-legal guarantees. Specialized sources are analyzed and on the basis of this analysis key features, aim and aims of notary administrative-legal guarantees are identified. Author analyzes requirements to candidates and presents relevant individual definition. System of qualification requirements for candidates to notary position is examined with justification of its positive and negative aspects. Author defines key aspects of equal conditions establishment for candidates to notary positions including individual interpretation of aim and tasks of candidates’ selection procedure. Author systematizes requirements to administrative-legal regulation of candidates’ selection procedure and formulates recommendations regarding amendments to relevant legislative provisions.
