Borodkіn M. Legal Facts as Grounds for Creation of Legal Relations Regarding Social Welfare.

The thesis is one of the first special complex studies of legal facts as grounds for creation of legal relations regarding social welfare. The thesis defines the stages of emergence and development of the doctrine of legal facts in the social security law, the definition, characteristics and significance of legal facts as grounds for creation of legal relations regarding social welfare, discloses the content of the criteria for their classification. The research covers the grounds for creation of legal relations regarding social welfare in the system of state social security regarding monetary payments, provision of medical assistance and free (preferential) provision of medicines, social services, provision of social privileges, housing and utility subsidies. Legal facts as the bases for creation of legal relations regarding social welfare in the sphere of non-state social security were analysed. The author defines the legal nature of the pension contract as a type of an agreement, which intermediates the constitutive legal fact within non-state pension legal relations. The thesis contains proposals for improving the current legislation regarding social welfare, related to stipulating and defining the content of legal facts as grounds for the creation of legal relations regarding social welfare.
