Shevchenko O. The administrative and legal status of an investigator in Ukraine

In the dissertation on the basis of the theory of administrative law, domestic and foreign legislation, achievements of public administration, a theoretical generalization was made and a new solution to the scientific problem concerning the administrative and legal status of an investigator in Ukraine was presented. The administrative and legal status of an investigator in Ukraine is described, which characterizes him as a representative of the judicial branch, who carries out pre-trial investigation of criminal proceedings. The place and role of the investigator in the administrative-legal relations is determined. The administrative rights of the investigator are formulated. It is proved that the administrative duties of an investigator in Ukraine are established by the norms of administrative law as a set of his obligations in the sphere of internal organization of the bodies of pre-trial investigation. A system of guarantees of the independence of investigators has been formed. A comparative description of the legal status of investigators in the EU member states, the United States and Ukraine has been made. Numerous amendments and additions to the current legislation on improvement of the administrative and legal status of an investigator in Ukraine are proposed.
