Solonova O. Victim’s testament as a source of evidence in criminal process

A complex research of theoretical grounds and practical problems of receiving, examination and evaluation of victim’s testament as a source of evidence in criminal process has been done in this research. Genesis of legislation concerning victim of crime has been analyzed, theoretical development of victim’s testament problems has been disclosed. Procedure of victim status acquisition in criminal process of Ukraine has been defined, its content has been discovered. Essence of victim’s testament, its subject and forms have been identified, procedure of questioning during victim’s interrogation in pretrial investigation and during court hearing has been ascertained. Ways of examination of victim’s testament (e.g. by his participation in investigative (search) actions and their evaluation with regard to affiliation, admissibility, sufficiency and credibility) have been characterized. Suggestions on improvement of criminal procedure legislation in terms of receiving, examination and evaluation of victim’s testament as a source of evidence have been offered.
