Dmytryshyna T. Juvenile sentencing at modern consequences.

The thesis is the first special comprehensive study of the theoretical and methodological and content foundations for the criminal punishment of juveniles in the current conditions of humanization of criminal policy. The purpose of the appointment of punishment and other criminal measures for minors as independent subjects of criminal legal relations is determined. The genesis of international legal acts on the peculiarities of sentencing to minors is researched. The peculiarities of the criminal punishment of juveniles according to the legislation of certain foreign countries are revealed. The general, special and special circumstances which are taken into account by the court when sentencing a juvenile under the legislation of Ukraine are investigated. The main directions of development of the institute of sentencing juvenile in Ukrainian legal doctrine and judicial practice are described. The theoretically substantiated proposals on perfection of the criminal legislation of Ukraine in the sphere of sentencing to minors are formulated.
