Savliak I. The secret of communication as the basis of criminal proceedings

In the dissertation the complex research of theoretical and practical problems of the secret of communication as a basis of criminal proceedings is carried out. The question of the concept and essence of this basis is considered. The stages of development of criminal procedural legislation and science concerning the secret of communication are determined. Investigative secret investigative (search) actions, which are variants of interference in private communication. An analysis of the prohibition of such an intervention was conducted. The procedure of the decision of the investigating judge to grant permission to interfere in private communication and its execution is considered. Proposals on making changes and additions to the Code of Criminal Procedure to improve the notion of communication secrecy as the bases of criminal proceedings and regulation of conducting audio, video control of a person, arrest, inspection and seizure of correspondence, removal of information from transport telecommunication networks, removal of information from electronic information systems have been developed.
