Essay

The dissertation is devoted to the solution of theoretical and practical issues related to the clarification of the witness testimony in criminal proceedings, as well as the improvement of its legal regulation. The novelty of the scientific positions and results is that this dissertation is the first in the national science of the criminal process the complex research based on the normative prescriptions of the Criminal Procedural Code of Ukraine in 2012, devoted to the peculiarities of clarification the reliability of witness testimony both during pre-trial investigation and during a court proceeding, in which are made the proposals to improve the existing criminal procedural legislation and scientific recommendations on the practice of its application. In the dissertation, the content of criminal procedural guarantees, which create conditions for giving reliable testimony to witnesses, their objective verification and evaluation, the peculiarities of the use of separate investigative (search) actions and secret investigative (search) actions to ascertain the authenticity of witness testimony under the time of pre-trial investigation, the means of determining the veracity of testimony during the trial and the peculiarities of assessing the authenticity of witness statements.
