Ostropilskyi B. Administrative and legal support for registration of rights to real estate

The dissertation covers in a comprehensive manner the problems of ensuring the registration of rights to real estate in Ukraine. Based on the analysis of existing approaches to understanding the essence of rights to real estate, the legal content of this category is synthesized. The mechanism of registration of rights to real estate is explored; a list of documents proving the validity of registration (title of ownership of a certain property); procedural order and ways to protect the person applying for registration; grounds for refusal. The place of state administration in the context of registration of rights to real estate in the system of the national policy of Ukraine is determined. The process of formation and historical development of the legislation of Ukraine on the issues of ensuring registration of these material rights has been studied. World real property registration systems are analysed in detail. The postulates of administration of the Robert Torrens system are investigated. In the context of the study, the legal problems of the right to real estate are described as a subject of the real estate registration system. In this paper, we study the administration of registration of rights to immovable property in the EU member states of the continental (Napoleonic) group. In the context of the study of the object of the legal register, the functions of the real estate registry and the status of registrars as the persons responsible for maintaining the property register. On the basis of theoretical conclusions and analysis of the current legislation, the experience of foreign countries, there are guidelines for improving the legal and regulatory support for registration of rights to real estate in Ukraine.
