Hrytsiv N. Forms and Methods of Control over Notarial Activity in Ukraine

The aim and the target of control over notarial activity are determined. The author’s classification of forms of control over notarial activity is substantiated. The legal nature of forms of control over notarial activity is interrogated, their most characteristic features are determined, as well as their essence and their main purpose. The forms of control over notarial activities are characterized in the author’s original definition, systematized and classified. The legal nature, the essence of verification as a form of control in the sphere of notary public are determined, its original author’s definition is formulated, as well as the classification of inspections according to various criteria is substantiated. The shortcomings of the administrative and legal regulation of the basis and procedure for conducting inspections are identified, as well as proposals for their elimination are substantiated. The aim, specific tasks, as well as general and special features of control methods in the sphere of notary public are determined and characterized. The author’s original definition of “method of control over notarial activity” is substantiated. The author’s classification of methods of control over notarial activity is suggested. The author’s original definitions of the use of methods of encouragement, persuasion and coercion during the control over notarial activities are formulated, as well as their system, the most characteristic features and specificities are determined.
