Holodnova T. Control as a guarantee of the legality of the property management of military units: administrative and legal principles

The thesis is devoted to the complex analysis of control as a guarantee of the legality of the property management of the military formations of Ukraine and its administrative and legal principles. The work defines such concepts as control, supervision, methodology of control investigation as a guarantee of legality of property management of military formations of Ukraine, property management of military formations of Ukraine, administrative and legal bases of control over military property management. The principles of control and supervision activity in the sphere of property management of military formations of Ukraine are analyzed and the division of these principles is proposed according to the level of significance: general and special, administrative and procedural; according to the sources of law: constitutional; principles of control and supervisory activity; the principles of control, which are established in sectoral regulatory legal acts. The subject, object, forms and methods of control in the field of property management of military formations of Ukraine are investigated and their concepts with the corresponding classification are proposed. The international experience of the legal control of property management of military formations is considered. Based on the results of the study of international experience in the field of defense , improvement of the current legislation of Ukraine in this aspect and the introduction of the relevant additions and amendments to it are proposed. For further improvement of the legislation of Ukraine and the practice of its application, the proposals concerning the necessity to pass the Law of Ukraine "On the Basic Principles of Control in the Management of Military Property of Ukraine" and amendments to existing laws and regulations in this area are formulated.
