In the dissertation the theoretical foundations of the mechanisms of public management for creation and functioning of cyber-physical systems in the branches of economy are grounded in accordance with the Concept of development of digital economy and society of Ukraine for 2018-2020 and the approved plan of measures for its realization and concrete proposals for their improvement have been developed.
The legislative consolidation of the procedure for creation of CPS is proposed, which should consist of the following elements: definition of the sphere of CPS operation and verification of compliance with the mandatory requirements for the CPS operation, to which the author includes the following: functional safety, access security, integrity, availability, resilience, time requirement, data semantics, identity, adaptability, "life cycle" requirement. The author has formed the proposal to consolidate, based on world experience, three phases (stages) of the CPS creation: conceptualization; realization; confirmation.
The concept-categorical apparatus has been improved, in particular, the author's definition of the concepts is given: "cyberphysical system"; "operator of the cyberphysical system"; "architecture of the cyber-physical system". The legislative regulation of the mechanisms of public management for the creation, operation, and compliance of CPS, which are functioning on the electric power industry objects on the Ukrainian electricity market, to the functional safety requirements, access security (and cybersecurity), integrity, availability, confidentiality, resilience, time standards (timeliness) of response of sensors, adaptability of CPS and other requirements has been improved by placing on the National Commission that carries out state regulation in the spheres of energy and communal services, the authority to carry out the mandatory certification of the interoperability of the relevant CPS.
The mechanisms of state support for innovative development of CPS, which are proposed in the dissertation, are considered as a complex of regulatory, institutional, organizational measures, which include: adoption of domestic and international standards as national in the field of creation and functioning of CPS; Lending for innovative projects from the state or local budgets on the creation of CPS in various sectors of the economy.
The author provided suggestions on the legal regulation of innovative ways of economic development of Ukraine through the proposal for the elaboration and adoption of the Law of Ukraine "On the Digital Economy of Ukraine", in which one section should be the Section on the procedure for the creation, operation, regulatory and legal support, public management of CPS and creation of a permanent independent state collegial body on CPS entrusting him with the authority to carry out inspections of objects on which the CPS operates in respect of compliance with the requirements of functional safety, access security (and cyber security), integrity, availability, confidentiality, resilience, standards of time (timeliness) of reacting of sensors, adaptivity of CPS and other requirements.
