Kovtun O. Evidence within Criminal Proceedings on Crimes Related to the Obstruction of Journalists’ Legitimate Professional Activities

The author of the dissertation has studied the doctrinal and applied aspects of evidence within criminal proceedings on crimes related to the obstruction of journalists’ legitimate professional activities. The present state of scientific research on the raised problems has been clarified; and the concept, meaning and limits of proving in this category of criminal proceedings have been revealed. The grounds and procedure of entering information into the Single Register of Pre-trial Investigations about crimes related to the obstruction of journalists’ legitimate professional activities have determined. The circumstances, which are subject to proving in criminal proceedings of this category of crimes have been distinguished and characterized. The author has provided characteristics to investigative (search) actions as means of collecting evidence and has revealed the procedure for carrying out secret investigative (search) actions while investigating crimes related to the obstruction of journalists’ legitimate professional activities. Other means of collecting evidence in this category of criminal proceedings have been specified. The author has offered scientifically substantiated propositions and recommendations for improving the current criminal procedural legislation of Ukraine in the context of the subject matter of the research.
