Komarova M. Legal and organizational foundations of the search in criminal proceedings

In the dissertation on the basis of the study of legislation, literary sources, the results of the generalization of investigative and judicial practice a comprehensive investigation of the search in the criminal proceedings was carried out. The historical and legal analysis of the formation and development of the search in the criminal process is considered. The foreign experience of conducting the search is analyzed and its comparative legal research is conducted. Procedural order of search in criminal proceedings is revealed and its types are investigated: search of housing or other person's possession and search of a person. The essence of prosecutorial supervision and judicial control during the search, which should guarantee the realization of the rights of the subjects involved in its conduct in criminal proceedings and provide for effective procedural means, has been clarified.
