Starosieltseva O. Financial and Legal Regulation of the State Social Insurance in Ukraine

The author of the dissertation has studied theoretical and methodological principles of financial and legal regulation of the state social insurance, the essence and importance of the state social insurance in the system of financial law, its principles, types of subjects and their legal status. The author has provided own definitions of the concept of «financial and legal regulation of the state social insurance» and has clarified their legal essence, principles, tasks and types. The objective, tasks and functions of public insurance activity as a type of financial activity of the state have been determined; and the author has researched the features of the state social insurance as a financial and legal institution having complex legal nature, since it combines the norms of material and procedural law. The author has established the essence of financial and legal relations within the mechanism of legal influence on the sphere of relations on compulsory state social insurance, realized in three functions of the involved subjects: in the insurers’ performance of powers on the formation and use of insurance funds, in the performance of duties by insured persons regarding the payment of insurance premiums, in the social protection of citizens, which is imposed on the state. The author has analyzed the experience of financial and legal provision of the organization of the state social insurance abroad and has grounded propositions for its improvement through the introduction of amendments and alterations to the current financial legislation.
