Tsalyn R. Peculiarities of the Legal Status of the Waste Owner in Ukraine.

The dissertation is devoted to a complex theoretical research of the legal status of waste owner in Ukraine. The concept and special features of waste as a specific object of property rights in Ukraine are considered in the work, the existence of a legal institute of ownership of waste is substantiated and the principles of this legal institute are defined. On the basis of the study of historical and foreign experience, a generalization of the peculiarities of the formation of the legal status of the waste owner is made not only in Ukraine but also in some foreign countries. The applicant has systematized the grounds for the emergence, transfer and termination of the ownership of waste of state, territorial communities, individuals and legal entities. The author has investigated the theoretical basis for establishing the legal status of the waste owner, his concept and content, identified and investigated the subjects of the ownership right to waste in accordance with Ukrainian legislation, as well as describes the legal personality, rights and responsibilities of the waste owner as the main elements of his legal status In addition, special attention is paid to the study of the peculiarities of the legal status of owners of certain types of wastes, in particular, household, industrial and hazardous wastes.
