Loiuk I. Administrative – procedural principles of creation of banks in Ukraine

The dissertation presents a complex scientific research of administrative procedural principles of creation of banks. Based on the analysis of acting legislation and theories and practices that exist in Ukraine and abroad, features of the administrative procedure, its correlation with administrative proceedings and administrative process are characterized. The main principles of administrative procedure, their content and prospects of reflection in the national legislation. It is found that the procedure for creating a bank in Ukraine includes several stages, which correspond to the registration, permitting, licensing and conciliation procedures. It is described the state of administrative and legal regulation of the stages of the bank creation process in Ukraine, analyzes their shortcomings and proposes ways to overcome them. The dissertation carried out a comparative legal analysis of the administrative and procedural principles of the creation of banks in foreign countries, on the basis of which proposed changes to the relevant legislation of Ukraine.
