Tkach O. Investigation of violations of the right to privacy

On the basis of the analysis of the scientific literature of national and foreign scholars as well as investigative and judicial practices, the author defines forensic description of violations of the right to privacy, which is disclosed with the help of such structural elements as the subject of a direct criminal offense, the method of crime, the evidence pattern and the offender. According to the author of the thesis, these key elements of the forensic characteristic of violations of privacy and their practical use will contribute to the effective, rapid, complete and objective investigation and detection of crime and its further prevention. The author's definition of private life is presented, which, together with the analysis of national and foreign legislation, made it possible to draw a conclusion on the subject of a direct criminal offense in the course of violations of the right to privacy, which serves as the basis for the introduction of possible method of committing a crime, which in turn helps to reveal evidence.
